(USCIS) Stands United States Citizenship Immigration Services

VISA : Visa is a Document that is placed in the passport to Enter or leave the particular country in a specific
time.

There are Two Types of Visas :
Immigrant Visa
Non – Immigrant Visa

Types of visa’s in USA :

F1 visa ( Student Visa) :  

  • It is a Visa given to the students all over the world who are willing to pursue their masters (or) Bachelors in the USA. But they are legally not eligible to work in USA 

  • The validity of an F1 visa is 5 years.

F2 visa :

It is a dependent visa of f1 and they are not legally eligible to work in USA

  • For example ( Spouse / Children )

CPT ( Curricular Practical Training ) :

  • Curricular practical Training is a temporally Authorization for f1 students in U.S.A

  • They are able to do job in university area only

  • CPT validity is 9 months.

OPT ( Optional Practical Training ) :

  • Optional practical training is given to the f1 students after the completion of their bachelors /Masters in U.S.A

  • They are eligible to work all over the U.S.A legally.

  • validity of OPT is 12 months and can extends up to 24 months  

  •  Total 12+24=36 months validity

  •  MBA students will have OPT only for 12 months.

 

H1B Visa :

  • H1B visa is a Employer sponsor visa

  • It is also called as non- immigrant visa

  • It allows foreign employers to work temporarily in USA in specific Occupation .

  • Validity is 3years and can extends up to 3years

    • So Total= 3 +3= 6years

H 4 :

It is a dependent visa of H1B and they are not eligible to work in U.S.A

G C( Green card ):

  • It is a Permanent Residence visa.

  • Validity up to 10 years

  • Where they can work all over the U.S.A

Citizen visa (USC):

  • The people who Took birth in U.S.A 

  • US Citizen can work in all over the USA

TN visa (Treaty Nafta ):

  •  NAFTA stands for ‘North American Free Trade Association’

  • It allows neighboring countries like Canadians and Mexicans to work in U.S.A

  • Validity is 3years.

B1 and B2 visa:

  • B1, B2 visa is given to the people all over the world to visit U.S.A for tourism, business, medical checkups etc..

  • Validity is 6months

L1 visa:

  • It is a Inter Company Transfer visa which allows employees to work in specific company and not allows to work in other companies.

  • Its Validity is 7years

L2 visa:

  • It is a dependent visa of L1 and they are legally eligible to work in U.S.A if they have EAD card.

EAD:

  • Employment Authorized Document.

  • It is a card given to the employee to work in U.S.A

E3 visa:

  • It is given to Australian citizens to work in U.S.A

  • Validity is 2 years.

 

Tax / Terms:

W2: 

  • On W2, candidates will work as a full time employee of a company.

  • Employers take care of employee and employee taxes.

  • Employer sends a w2 form to the candidate in the month of January, for the previous year wages and deductions.

  • Candidates submit tax returns to IRS(INTERNAL REVENUE SERVICE)

 Eligible Candidates: American Citizen (USC), Green Card (GC) Holder, EADs (Employer Authorization Document), TN Permit (Canadian & Mexicans Visa), OPT (Optional Practical Training), CPT (Curricular Practical Training), H1B, L1 etc.

   W2-Salary with benefits:-)           

  • This is FULL TIME, PERMANENT JOB.

  • Employees will be paid salary and get benefits like joining bonus, vacation, holidays, workers compensation, relocation expenses, leave encashment, IRA, Health/Vision/Dental/ Life Insurance, 401k, Education Benefits, retirement plans etc.

  • Usually companies pay the candidate when there is no job or in between projects.

W2 – Hourly with benefits:

  • This is a FULL TIME, TEMPORARY job. 

  • Employees will be paid on hourly basis and they will be enjoying benefits also.

  •  As soon as the contract period is over, the employee has to find another job.

W2 – Hourly with no benefits:

  • This is a FULL TIME, TEMPORARY job.

  •  Employees will be paid on hourly basis and there are no benefits.

Contract – Independent (1099):

  • Candidate will work as a contractor for a company for that contract period. 

  • Company sends a 1099 form to candidates in January, for the amount earned in the previous year. 

  • Based on this 1099 form, candidates will submit tax returns to the IRS, which includes employee and employer taxes.

Contract to Hire – Independent (1099):

  • To start with, candidates will work as a contractor for a company and later will be hired as a full time, permanent employee for that company.

  •  In January, the company sends a 1099 form for the amount earned previous year in the contract period.

  •  In addition, they also send a w2 form to the candidate in January, for the previous year wages and deductions earned after hiring him as a fulltime employee. 

  • Based on this w2/1099 form, Candidate will submit tax returns to the IRS, which includes employee and employer taxes.

Contract between a Company and another Company:

Contract- Corp to Corp:

  • This is a contract between one company (Client) and another company (Vendor).

  • Here Vendors Candidates will work With Client and Client sends 1099 form to Vendor.

Contract To Hire-Corp To Corp:

  • Vendor Candidates work with Client on contract for a particular duration and later they will be hired as Permanent Employee of the Client.

  • Client sends 1099 form to Vendors for the contract Period Worked by the Candidates.

  • After hiring the candidates into the candidates for the wages earned during the previous year.
